Suspended License & Traffic

Traffic Violation Attorney

Suspended License Offenses • Traffic Infractions

Traffic offenses can carry steep fines, while the accumulation of too many points against your driver's license within a certain period of time can result in the loss of driving privileges. Moreover, if your license is already suspended, and you are charged with a traffic violation, you may face jail, a criminal conviction, and/or additional years of suspension or permanent revocation.

  • Driving without insurance

  • Speeding / driving too fast for conditions
  • Disobeying a traffic control signal / Failure to yield
  • Illegal turning or passing

We can also provide representation for clients seeking driver's license reinstatement

Suspended License Offenses

If you are charged with a first offense of driving on a suspended license, or driving after revocation, and the original, underlying offense was alcohol-related (DUI), punishment includes a mandatory minimum of 10 days in jail – or the option of 30 days in the Sheriff’s Work Alternative Program (SWAP). A repeat offense of DWLS can be enhanced to a felony, with jail time of six months to a year.

Driving without insurance

A conviction can carry a minimum fine of $500. Continuing to drive without insurance may lead to a suspension of driving privileges. Mr. Sandquist, can often help clients avoid additional suspension and minimize these harsh penalties by getting charges reduced to lesser offenses.

Serious Traffic Offenses / Multiple Violations

Certain traffic offenses carry hefty minimum fines and penalties. For example, a speeding ticket in a highway work zone is $375 for the first offense and $750 for the second offense. Speeding in a school zone or passing a stopped school bus can also result in major fines and suspension of your license.

Avoiding conviction for even a minor traffic violation can be extremely important. Drivers under the age of 21 face license suspension for two traffic convictions in a 24-month period, while drivers over 21 who have more than three convictions in any 12-month period will have their driving privileges suspended and current Illinois law allows only two supervisions for any driver within a twelve month period. At Molohon Sandquist & James, LLP we aim for dismissal, reduced charges, or court supervision in lieu of conviction, which avoids points against your license and is not reported to your insurance company.
